chosen report through answering a series of questions. Students need to apply a similar approach to
that used in the Topic 1 tutorial case study, ‘The Swimming Stadium’, to their chosen media report.
Therefore, students will need to use their issue identifying skills to assess and analyse the legal issues
that arise in their chosen article.
Word Limit
The assignment should be a minimum of 500 words and not exceed 2000 words. Please provide a
word count on your cover sheet. A penalty of 10% will be imposed for every 100 words that exceeds
the word limit. The assignment will not be assessed if it exceeds 3000 words and will result in a ZERO
mark.
Assignment One must be submitted by 1pm WST on Monday of Week 5 (27 March 2017).
Students’ grades and feedback will be provided by way of an audio voice file available on My Grades
on Blackboard.
2. Assignment Two: Case study (30 marks)
Students will be provided with a case study and be required to address two legal questions using the
four step process. The assignment will require students to solve the legal issues arising in the case
study by explaining and applying their knowledge of the legal principles and rules arising in the
Australian legal system. A vodcast explaining the four step process has been posted to blackboard
(under the ‘Assessment’ tag) to assist students in completing this assignment.
Please note that the information contained in the course materials (the text book, lecture materials and
case summaries on blackboard) are sufficient when completing your assignment. It is not necessary to
research beyond these materials for the purpose of completing the assignment.

Description

  1. There are different areas of law that are applicable to this case. One of the areas of law that is applicable to his is contract law (Glenn, 2000). In the case, MrYan has been contracted to provide cleaning services to an apartment block on John Street, Lidcombie between September 2011 and July 2014. However, the defendant, Mr Mehajer says his company SM Projects had subcontracted the cleaning services to another company, Downtown Project Development, which had further contracted Mr Yan to provide the cleaning services. To understand whether there was a valid contract between Mr Yan and Mr Mehajer, contract law should provide the required guidance.

Another area of law that is applicable in this case is corporation law. This area of law mainly concerns with the study of how shareholders, directors, employees, creditors, and other stakeholders like consumers, community, and others relate with one another (Reiner et al., 2004).   Corporation law is applicable in this case to decide whether Mr Mehajer is a direct of the said company, Downtown Project Development. The defendant says the company is run by his sister but there is a sworn affidavit that shows Mr Mehajer as the sole directors of the company. In this case, corporate law will help to determine whether Mr Mehajer is the director of the Downtown Project Development, and whether he bears the liability for the debts incurred by the company. One of the most important roles of corporation law is to discourage directors from exploiting tither position of power.
